INDIVIDUAL TRAINING

1. General remarks
Our general terms and conditions exclusively are applicable as from the client's registration on our Internet site, www.berlitz.be. There can be no exception to this rule except by express written agreement signed by both parties.

2. Registration
The client registers for the training that he/she has chosen by clicking on the "reserve" button. By confirming his/her reservation, the client sends BERLITZ his/her irrevocable commitment to follow the aforementioned training subject to the right of cancellation provided for in article 3.

As soon as it receives the registration, BERLITZ will send the client a confirmation e-mail including the description of the training.
The client's registration as covered in the confirmation e-mail from BERLITZ obligates the client to following the training during the period specified and the time slots indicated.

3. Cancellation
The client has the right to cancel his/her registration within 14 days from the confirmation e-mail from BERLITZ. It is absolutely mandatory that the client's cancellation be sent to The Berlitz Schools of Languages of Benelux SA/NV by recorded delivery post at its registered office in 1050 Brussels, avenue Louise 306-310.

If the cancellation occurs within 14 days from the confirmation e-mail from BERLITZ, within a short period of time the latter will reimburse the client the amounts already paid, with the deduction of a sum of 35.00 € for administrative costs.

When this time period has passed or if the course has already begun, no cancellation is possible any more, and BERLITZ will retain the price of the training.

4. Sequence of the lessons
Each lesson will last 45 minutes including a 5 minute break. In order to ensure the quality of instruction given, the client agrees to accept the presence of a teaching adviser at certain lessons. The lesson plan for individual training courses will be defined between BERLITZ and the client before the beginning of the session.

The students will have the ability to cancel or postpone certain lessons if they notify the secretariat of the BERLITZ centre organizing the training course at the latest by 14.00 the last working day that precedes the lesson. Any specific lesson missed without notification in writing cannot be compensated for. After two consecutive absences without notification, the schedule planned for the specific lessons may be suspended in the interest of the student. Requests for modification of schedules for specific lessons will have to be sent in writing to the secretariat of the organizing centre and will be subject to the approval of BERLITZ.

Credit for lessons not taken may be reimbursed as long as the request for this has been made by recorded delivery letter to the BERLITZ centre organizing the lessons within six (6) months from the beginning of the training, with a deduction of a fixed amount of 50.00 € for administration expenses.

5. Availability of the instructors
With the objective of ensuring that students are accustomed to a variety of pronunciations, a change of instructor can happen. There is no right to instruction by a specific instructor.

6. Price information
The price of the training does not include the teaching material that the client will have to purchase during the first lesson, after having sat a test that evaluates his/her linguistics skills. The prices listed on the BERLITZ Internet site are understood as including VAT, except for teaching services, which are not subject to the tax on added value.

7. Conditions of payment
Invoices from BERLITZ are payable in cash. Any delay in payment will lead to the application of interest on overdue payments of 12% per year and of a penalty clause of 15% of the amounts due on the principal.

8. Copyright and teaching materials
The teaching material written and supplied by BERLITZ is subject to copyright and may not be used or reproduced even partially for commercial uses without prior written authorization from BERLITZ.

Teaching materials will remain the property of BERLITZ until they have been paid for in full.

9. Internet site and incorporated third party web sites
BERLITZ declines all responsibility as to the accessibility of its Internet site.
The Internet site www.berlitz.be may mention web sites of third parties. BERLITZ may not in any case be held liable for the content of these sites or the veracity of the information covered there.

10. Guarantee and liability
BERLITZ declines any liability in the event that the student does not achieve his/her learning objectives. In this regard BERLITZ is held only to an obligation of due care. The student undertakes to follow the lessons with assiduity and application.

BERLITZ also declines any responsibility in the event of loss, theft or damage of objects brought into its premises by the participant.

11. Data protection
The clients' data is stored in internal files at BERLITZ in compliance with the legal arrangements in order to keep them informed of future training courses likely to interest them. Clients who do not wish to be informed are asked to notify BERLITZ by e-mail (info@berlitz.be) indicating their client number.

12. Dispute
In the event of a dispute, only the courts of the judicial district of Brussels shall be competent, and Belgian law alone shall be applicable.

GROUP TRAINING

Group lessons will be given on the days and at the time set by BERLITZ and may not under any circumstances be postponed or reimbursed. During the first lesson a test to evaluate the student's linguistics skills will be given in order to place him/her in the appropriate group.

In the interest of the students, BERLITZ may eliminate or merge certain classes if the number of participants is insufficient or split them if there are too many students. If the number of participants is lower than the minimum number required to start up the formula selected, BERLITZ will adapt the number of lessons depending on the number of participants.

BERLITZ will also be able to transfer a student into a different group if it corresponds better to his/her level.

LANGUAGE CAMPS FOR KIDS AND TEENS

1. General remarks

4. Sequences of the lessons
The extent of the services provided within the framework of the camp appears in the information published at www.berlitz.be. If one of the services cannot be supplied due to an act of God (for example serious weather conditions), BERLITZ reserves the right in this specific case to carry out a replacement programme. Cancellation of the camp due to the modification of the services is not possible.

Any reimbursement is ruled out when a child leaves the camp voluntarily, further to inappropriate behaviour or if he/she falls ill. If the child needs medical assistance during the camp, all the additional costs such as travel to a physician or to the hospital, or the purchase of medicines, must be reimbursed to BERLITZ by his/her parents or guardian at the first request.

BERLITZ declines any liability for damage suffered by the participants or third parties, as long as they were not caused by the error or serious negligence of the supervisory staff hired by BERLITZ. Any liability for slight negligence is ruled out. BERLITZ also declines any liability in the event of the loss, theft or damage to objects brought by the participant.

The parents or guardian of the participating minor undertake to take out family insurance covering the civil liability of the participant for all damage in general of any kind that the participant might cause.

It is recommended that electronic devices and games, jewellery and valuable objects not be brought to the lessons.

Refund Policy

1.Our general terms and conditions are applicable exclusively as of the learner's enrolment. No exceptions may be made to these rules except by express written
agreement, signed by both parties.

2.Group courses will be held on the dates and times determined by Berlitz and may under no circumstances be postponed or reimbursed. Lessons falling on a public holiday will be brought forward. If the minimum number of participants for a group course is not reached, the course will not start and a reimbursement will take place within a maximum of 4 weeks. In order to habituate learners to a variety of pronunciations, teachers may be changed.

3. Fees for private and group courses are payable in advance at the time of enrolment. For companies, the invoice will be issued upon receipt of the purchase
order and will be payable cash.

4. If, however, some monies remain outstanding after the course start date, BERLITZ will have the right to claim, in addition to the principal, a penalty interest of 12% per annum and to invoke the application of a penalty clause of 15% on the sums payable.

5. The rate applicable upon the date of enrolment remains in effect for three months. Beyond this period, outstanding lessons may be subject to adjustment to
take account of increased costs.

6. For private face to face courses, learners can cancel or postpone certain lessons provided they notify the school's planning office, by email only, before 2.00
pm on the last working day before the lesson in question. Private distance lessons can be cancelled or postponed at bvc@berlitzeu.com before 1.00pm on the
last working day before the lesson in question. No private class missed without notice can be recouped. After two consecutive absences without notice, the
scheduled timetable for the private lessons may be suspended, in the interests of the learner. At the request of the learner or his or her company, the value of
classes not taken may be transferred to any other school within the BERLITZ Group, notwithstanding the fact that the new school may apply a different rate.
Credit for classes not taken may also be reimbursed, provided that this is requested by registered letter within 6 months of the enrolment date and subject to
the deduction of administrative costs at the fixed rate of 40 Euros.

7. Face to face and distance group lessons will be held on the days and at the times determined by BERLITZ and may under no circumstances be postponed or
reimbursed. In the interests of learners, BERLITZ may withdraw or merge some classes if the number of participants is too low or, alternatively, split them if
numbers are too high. BERLITZ may also transfer a learner to another class if this is more commensurate with his or her level.

8. In order to habituate learners to a variety of pronunciations, teachers may be changed if the timetable permits.

9. All lessons (except for telephone lessons) will be of 45 minutes' duration, including a 5-minute break.

10. All private telephone lessons will be of 30 minutes' duration. Learners can cancel these lessons up to 6 hours before the start of the lesson, via the
Netplanning platform.

11. Any complaints relating to teaching materials must be sent by registered letter to BERLITZ within eight days of their delivery, under penalty of forfeiture of
entitlement. However, materials will remain the property of BERLITZ until such time as they have been paid for in full.

12. In the event of any dispute, the courts of the judicial district of Brussels will have sole jurisdiction and only Belgian law will apply

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
